1. Agreement to Terms

By downloading, installing, or using the Pauso mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Moka IT Engineering Kft. ("Company," "we," "us," or "our"), a company registered in Hungary.

2. Eligibility and Age Requirements

2.1 General Use

The App is rated 4+ and is suitable for all ages. However:

Users under the age of 13 must have parental or guardian permission to use the App
Users under the age of 13 are restricted to local-only features and cannot create accounts or use cloud sync
Parents and guardians are responsible for supervising their children's use of the App

2.2 Account Creation

To create an account and use cloud sync features, you must be at least 13 years old, or the minimum age required in your country to consent to data processing.

3.1 What Pauso Does

Pauso is a screen time management application designed to help you build healthier digital habits through:

Gentle Mode: Guided breathing exercises before accessing protected apps, followed by a mindful choice to continue or step away
Strict Mode: Time-based blocking of apps using Apple's Screen Time API, preventing access during scheduled periods
Usage Tracking: Statistics about your breathing exercises, blocked attempts, and time saved
Achievements: Gamification elements to encourage positive habits

4. User Accounts

4.1 Account Creation

Account creation is optional. You may use the App without an account, with all data stored locally on your device.

If you choose to create an account:

You must use Sign in with Apple
You are responsible for maintaining the security of your Apple ID
You are responsible for all activities under your account

4.2 Account Termination

By You: You may delete your account at any time through the App settings. Upon deletion:

Your cloud data will be permanently deleted within 30 days
Your local data will remain on your device until you uninstall the App
Active subscriptions must be cancelled separately through Apple

By Us: We may suspend or terminate your account if you:

Violate these Terms
Use the App for illegal purposes
Attempt to circumvent security measures or abuse the service

5. Subscriptions and Payments

5.1 Subscription Options

Pro features are available through the following subscription options:

Monthly: $4.99 USD per month
Annual: $19.99 USD per year
Lifetime: One-time purchase for permanent Pro access

Prices may vary by region and are subject to change. Current prices are always displayed in the App before purchase.

5.2 Payment Processing

All payments are processed by Apple through the App Store. By making a purchase, you agree to Apple's terms and conditions for in-app purchases.

5.3 Automatic Renewal

Monthly and annual subscriptions automatically renew unless cancelled
You will be charged within 24 hours before the end of the current period
You can manage or cancel your subscription in your Apple ID account settings

5.4 Refunds

All refund requests must be directed to Apple, as they process all payments. We do not have the ability to issue refunds directly. To request a refund:

5.5 Free Trial

If a free trial is offered:

You will not be charged during the trial period
Your subscription will automatically begin at the end of the trial unless cancelled
Free trials are limited to one per Apple ID

6. User Conduct

6.1 Acceptable Use

You agree to use the App only for its intended purpose of personal screen time management and in compliance with all applicable laws.

6.2 Prohibited Activities

You may not:

Use the App for any illegal purpose
Attempt to reverse engineer, decompile, or disassemble the App
Circumvent or attempt to circumvent any security features
Use the App to harm, harass, or infringe on the rights of others
Redistribute, sublicense, or resell access to the App
Use automated systems or bots to interact with the App
Misrepresent your identity or affiliation

7. Intellectual Property

7.1 Our Rights

The App, including its design, code, graphics, Pauso mascot, logos, and all content created by us, is owned by Moka IT Engineering Kft. and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7.2 Your Content

You retain ownership of any content you create within the App, such as custom intentions. By using the App, you grant us a limited license to store and process this content solely to provide the App's functionality.

7.3 Feedback

If you provide suggestions, ideas, or feedback about the App, you grant us the right to use such feedback without compensation or attribution to you.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

9. Disclaimers

9.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guaranteed Results

We do not guarantee that:

The App will help you reduce your screen time
The App will be uninterrupted, error-free, or secure
Any specific health, wellness, or productivity outcomes will be achieved
The breathing exercises or blocking features will work in all circumstances

9.3 Screen Time API Limitations

Strict mode relies on Apple's Screen Time / Family Controls API. We are not responsible for:

Changes to iOS that affect the API's functionality
Situations where Apple's restrictions do not work as expected
Bypasses or workarounds that may exist within iOS

9.4 Third-Party Services

We are not responsible for the availability, accuracy, or content of third-party services (Apple, RevenueCat, Supabase) that the App integrates with.

10. Limitation of Liability

10.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

10.2 Excluded Damages

WE SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Damages resulting from your inability to use the App
Damages resulting from unauthorized access to your data
Damages resulting from third-party services

10.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Moka IT Engineering Kft. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Any content you create or submit through the App

12. Modifications

12.1 Changes to the App

We reserve the right to:

Modify, update, or discontinue any feature of the App at any time
Change subscription pricing (existing subscribers will be notified in advance)
Discontinue the App entirely with reasonable notice

12.2 Changes to These Terms

We may update these Terms from time to time. When we make material changes:

We will update the "Last Updated" date
We will notify you through the App or via email
Continued use after changes constitutes acceptance

If you do not agree to the updated Terms, you must stop using the App and cancel any active subscription.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of Hungary, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Hungary, specifically in Békéscsaba or Budapest, at our discretion.

13.3 EU Consumer Rights

If you are a consumer in the European Union, you retain any mandatory consumer protection rights granted by the laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

13.4 Class Action Waiver

To the extent permitted by law, you agree to resolve any disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under them. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We are not liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, or strikes.
